These Terms of Use apply to the Polku Learning website and the related digital services. The services include S2-Selkokieli, ESL Simplifier, Open Digikalenteri, and other digital tools, materials and content provided by Polku Learning.

By using a service, creating a user account, or purchasing a product or subscription, you agree to these Terms of Use.

1. Purpose of the services

Polku Learning provides digital tools and materials for teachers, trainers and educational institutions.

The services are primarily intended for adult users, such as teachers, trainers, educational staff and other professionals working in education or training.

The services are not intended for independent use by children.

2. Age requirement and user status

The services are intended for adult users.

By creating a user account, using a service, or purchasing a product or subscription, the user confirms that they are at least 18 years old or are using the service as an authorised representative of an organisation.

If the user accesses a service on behalf of an employer, educational institution or other organisation, the user is responsible for ensuring that they are authorised to use the service on behalf of that organisation.

3. User accounts

Some services require the creation of a user account.

The user is responsible for ensuring that the information provided during registration is accurate and up to date.

The user is responsible for keeping their username, password and other login credentials secure. The user may not allow another person to use their account without separate permission from Polku Learning.

Polku Learning may suspend or close a user account if the user breaches these Terms, misuses a service, or causes harm to the service, other users or Polku Learning.

4. Paid services

Polku Learning offers one-time digital purchases and monthly subscription services.

Open Digikalenteri is a one-time digital product. S2-Selkokieli, ESL Simplifier and other similar services are offered as monthly subscription services unless otherwise stated in connection with the relevant product or service.

The current price, payment method, subscription period, automatic renewal terms and other essential purchase information are displayed during the purchase process before payment is confirmed.

Payments are processed through Stripe. Polku Learning does not store users’ full payment card details in its own systems.

5. Delivery of digital products and services and right of withdrawal

Polku Learning provides digital content and digital services.

Digital content or a digital service is delivered to the user after purchase by providing access to the product, service, user account, digital material or application features.

Consumers generally have a statutory 14-day right of withdrawal in distance sales. The scope of the right of withdrawal and any applicable exceptions are determined under consumer protection legislation based on the type of digital content or service concerned.

If delivery of a product or service begins at the consumer’s request during the withdrawal period, the user will be informed before purchase of the possible effects of withdrawal and any consent required by law will be obtained where applicable.

Information concerning the right of withdrawal is provided to the user before the purchase is confirmed.

Nothing in these Terms limits any mandatory rights granted to consumers under applicable consumer protection legislation.

Open Digikalenteri

Open Digikalenteri is a one-time digital content product that is delivered by providing the user with access to the product after purchase.

Consumers generally have a 14-day right of withdrawal. If the consumer requests that delivery of the digital content begins immediately before the withdrawal period has expired, expressly consents to this, and acknowledges that they will lose their right of withdrawal, the right of withdrawal ends when delivery of the digital content begins.

The consumer will receive confirmation of this consent and acknowledgement on a durable medium.

The loss of the right of withdrawal does not limit the consumer’s statutory rights where the digital content is defective under applicable consumer protection legislation.

6. Monthly subscriptions

Monthly subscriptions to S2-Selkokieli and ESL Simplifier renew automatically until cancelled by the user.

A monthly subscription may be cancelled through the user account. Cancellation prevents the next billing period from being charged, and the user will continue to have access to the service until the end of the billing period already paid for unless otherwise stated in connection with the service.

Consumers also have a statutory 14-day right of withdrawal from the date the agreement is concluded.

If the consumer requests that use of the service begins before the 14-day withdrawal period has expired and subsequently exercises the right of withdrawal, Polku Learning may charge a reasonable amount permitted under consumer protection legislation for the part of the service provided before withdrawal, provided that all information and requests required by law have been properly provided and obtained.

Normal cancellation of a subscription and exercise of the statutory right of withdrawal are separate matters. Payments for a billing period that has already begun are not refunded solely because the user cancels the ongoing subscription during that billing period. This does not limit the consumer’s statutory rights of withdrawal or any rights relating to defects or refunds.

7. Development stage and pricing

Polku Learning services are evolving digital products and services. Some services may be in an early release or development stage.

The current development stage, scope of available features and any known functional limitations are described to the user in the service description or during the purchase process.

The user understands that features, user interfaces, content and technical solutions may be developed, changed and improved during use of the service.

The services may occasionally contain individual errors, omissions, service interruptions or functional limitations. Pricing may reflect the current development stage, scope of features and known limitations of the service.

An individual error, omission, service interruption, functional limitation or AI-generated result that differs from the user’s expectations does not automatically entitle the user to a refund if the service has otherwise substantially operated as described at the time of purchase.

Polku Learning aims to correct material defects within a reasonable time and to develop its services based on user feedback.

The development stage or pricing of a service does not limit the consumer’s statutory rights where the service is defective under applicable consumer protection legislation.

8. Licence to use the services

Polku Learning grants the user a personal, limited, non-exclusive and non-transferable right to use the services in accordance with these Terms.

The user may not:

  • copy, resell or commercially distribute the service or any part of it

  • attempt to break, circumvent or interfere with the service’s technical protections

  • use the service unlawfully

  • use the service to develop, train or improve a competing product or service

  • share their user account with others without authorisation.

9. Use of materials generated through the services

The user may use materials generated through Polku Learning services in their own teaching and with their own teaching groups.

The user may:

  • edit generated materials

  • print them for teaching purposes

  • distribute them to their own students or learners for educational purposes

  • use them internally within their own educational institution

  • save them for their own teaching use.

Without separate written permission from Polku Learning, the user may not:

  • resell generated materials

  • publish them openly online

  • distribute them through public material repositories

  • include them in a commercial materials package

  • use them to develop, train or improve a competing service

  • present materials generated through Polku Learning services entirely as their own commercial product.

Under an institutional licence, materials may be used for teaching within the licensed educational institution for the duration of the licence. Materials may be shared with staff and students within the institution for educational purposes, but may not be published openly online, sold or distributed to third parties without separate permission.

10. Content submitted by users

The user is responsible for content submitted to the services, including topics, texts, instructions, files, assignments and other materials.

The user confirms that they have the necessary rights to use the content submitted to the service and, where the service requires AI processing, to submit and process that content through an AI service.

The user must not submit sensitive personal data, confidential student or learner information, health information, personal identity numbers or other confidential information to the services.

11. AI-generated content

Some Polku Learning services use artificial intelligence or automated content generation.

AI-generated content may contain errors, omissions, inaccuracies, outdated information, language issues or pedagogically unsuitable content.

The user is always responsible for reviewing the content, language, level, copyright suitability, accessibility and pedagogical appropriateness of the materials before using them in teaching.

Polku Learning does not guarantee that AI-generated content is error-free, complete or suitable for teaching without review.

12. Copyright and intellectual property rights

The Polku Learning website, services, user interfaces, brand, logos, texts, templates, software and other original content are owned by Polku Learning or its licensors unless otherwise stated.

No ownership rights in the Polku Learning services, software, brand or underlying systems are transferred to the user.

The user retains the rights to their own original content submitted to the services.

13. Service availability and changes

Polku Learning aims to keep its services available as reliably as reasonably possible.

Services may nevertheless experience interruptions, errors, maintenance periods or technical issues.

Polku Learning may make changes required for maintenance, security, compliance with law or regulatory requirements, technical operation or continued development of the services.

If a material change is made to a paid digital service and the change affects the user’s ability to use the service, the user will be informed of the change and of any applicable rights in accordance with consumer protection legislation.

14. Limitation of liability

To the extent permitted by law, Polku Learning is not liable for indirect losses, interruption of teaching activities, loss of data, disruptions caused by third-party services, or losses resulting from misuse of the service or use contrary to these Terms.

To the extent permitted by law, Polku Learning’s liability is limited to the amount paid by the user for the relevant service during the preceding three months.

This limitation of liability does not restrict any mandatory rights granted to consumers under applicable consumer protection legislation.

15. Third-party services

The services may use third-party services, including payment services, login services, technical service providers, analytics services or artificial intelligence services.

The terms and privacy policies of the relevant third-party providers may also apply to those services.

16. Termination

The user may stop using the services at any time.

Paid monthly subscriptions may be cancelled through the user account in accordance with Section 6.

Polku Learning may terminate or suspend a user’s access if the user materially breaches these Terms or misuses a service.

17. Changes to these Terms

Polku Learning may update these Terms, for example, due to changes in legislation, regulatory requirements, technical implementation, security requirements or the operation of the services.

The current version of the Terms will be published on the Polku Learning website.

Users will be informed in advance, where required by law, of material changes affecting existing consumer agreements.

Changes to these Terms do not limit any mandatory rights granted to consumers under applicable law.

18. Governing law and dispute resolution

These Terms are governed by the laws of Finland.

Any disputes should primarily be resolved through negotiations between Polku Learning and the user.

Consumers may contact Finnish Consumer Advisory Services and may refer a dispute to the Finnish Consumer Disputes Board.

Consumers also have the right to bring a dispute before a competent court in accordance with mandatory applicable law.
