CANCELLATION AND REFUND POLICY

These Cancellation and Refund Terms apply to Polku Learning's digital products and services, including Open Digikalenteri, S2-Selkokieli, ESL Simplifier and other digital services provided by Polku Learning.

1. Digital products and services

Polku Learning provides digital products and services.

Some products are purchased for a one-time fee, while some services are offered as monthly subscriptions.

Digital content or a digital service is made available to the user immediately after purchase by providing access to the product, service, user account, digital material or application features.

2. Right of withdrawal for digital products and services

Consumers generally have a statutory 14-day right of withdrawal in distance sales.

The scope of the right of withdrawal and any applicable exceptions depend on whether the purchase concerns one-time digital content or an ongoing digital service.

The cancellation terms for Open Digikalenteri are described in Section 3.

The cancellation and subscription termination terms for the S2-Selkokieli and ESL Simplifier monthly services are described in Section 4.

Nothing in these terms limits any mandatory rights granted to consumers under applicable consumer protection legislation.

3. Open Digikalenteri

Open Digikalenteri is digital content purchased for a one-time fee and delivered by providing the user with access to the product after purchase.

Consumers generally have a 14-day right of withdrawal.

If the consumer requests that delivery of the digital content begin immediately before the end of the withdrawal period, gives their express consent to this and acknowledges the loss of the right of withdrawal, the right of withdrawal ends when delivery of the digital content begins.

The consumer will receive confirmation of this consent on a durable medium.

The loss of the right of withdrawal does not limit the consumer's statutory rights where the digital content is defective under applicable consumer protection legislation.

4. Monthly subscriptions

S2-Selkokieli, ESL Simplifier and other similar services are offered as monthly subscriptions unless otherwise stated in connection with the service.

The monthly subscription renews automatically until the user terminates the subscription.

The monthly subscription can be terminated through the user's account. Termination prevents the next billing period from being charged, and the user retains access to the service until the end of the billing period already paid for.

Consumers also have a statutory 14-day right of withdrawal from the date the contract is concluded.

If the consumer requests that use of the service begin before the end of the 14-day withdrawal period, the service may be made available immediately. If the consumer subsequently exercises their statutory right of withdrawal within the 14-day period, Polku Learning may charge the reasonable amount permitted by applicable consumer protection legislation for the portion of the service supplied before withdrawal, provided that the information required by law has been given and the consumer's request to begin the service has been properly obtained.

Normal termination of a subscription and exercising the statutory right of withdrawal are separate matters.

Normal termination of a subscription does not entitle the user to a refund of a billing period that has already begun. If the consumer exercises their statutory 14-day right of withdrawal, refunds and any reasonable payment for the portion of the service already supplied will be handled in accordance with applicable consumer protection legislation.

This does not limit the consumer's statutory rights of withdrawal or any rights relating to defects or refunds.

5. Development stage and pricing of the service

Polku Learning's services are evolving digital products and services. Some services may be at an early release or development stage.

The current development stage of the service, the scope of its features and any functional limitations are described to the user in the service presentation or during the purchase process.

The service may occasionally contain errors, shortcomings, interruptions or functional limitations. The price of the service has been set taking into account its current stage of development, the current scope of its features and any functional limitations.

An individual error, shortcoming, interruption, functional limitation or an AI-generated result that differs from the user's expectations does not automatically entitle the user to a refund if the service has substantially functioned as described at the time of purchase.

Polku Learning aims to correct material errors within a reasonable period of time.

The development stage or pricing of the service does not limit the consumer's statutory rights where the service is defective under applicable consumer protection legislation.

6. Refunds in the event of technical problems

If the user is unable to access a purchased service due to a technical error, the user should contact Polku Learning at info@polkulearning.com.

Polku Learning will primarily seek to correct the error or restore access to the service.

If the error is not corrected within a reasonable period of time and the service cannot substantially be used, the user may be entitled to a price reduction or refund depending on the circumstances.

7. Dissatisfaction with service content

Polku Learning's services are digital tools, and some content is based on the user's own selections, information entered by the user or AI-generated results.

An individual result that the user finds unsatisfactory does not entitle the user to a refund if the service has functioned as described at the time of purchase.

If there is a clear defect in the service or the service does not correspond to what was promised at the time of purchase, the user should contact Polku Learning.

8. Making a cancellation or refund request

Polku Learning provides an electronic cancellation function on its website for exercising the statutory right of withdrawal. The user will receive confirmation of the cancellation notice on a durable medium.

The consumer may also submit a cancellation notice in another clear manner, for example by email to info@polkulearning.com.

Requests concerning refunds or defects in the service may be sent to info@polkulearning.com.

Disclaimer for AI-generated content

S2-Selkokieli and ESL Simplifier use artificial intelligence and automated content generation to create and adapt learning materials, texts, tasks and exercises.

AI-generated content may contain errors, inaccuracies, outdated information, omissions, language issues or pedagogically unsuitable content.

The user is always responsible for reviewing the material before using it in teaching.

Items to be checked include, for example:

• accuracy of the content

• language level

• pedagogical suitability

• suitability for the learners' age and skill level

• cultural and ethical appropriateness

• copyright

• accessibility

• the educational institution's own guidelines and curriculum.

Polku Learning does not replace the professional judgement of a teacher, trainer or educational institution.

The service is intended to support lesson planning and the preparation of learning materials. It is not an automatic system for approving final teaching materials.

Users must not enter confidential student information, sensitive personal data, health information or other confidential material into the service.

The user is responsible for ensuring that they have the necessary rights to use any material they submit to the service and to have that material processed by an AI service.

Accessibility

Polku Learning aims to make its website and digital services as easy to use and accessible as possible.

The aim is for the service to work on different devices and for its content to be as clear, understandable and technically functional as possible.

As the service is continuously being developed, some parts may not yet meet all accessibility requirements.

Monthly subscription acceptance

I request that access to the service begin immediately before the end of the 14-day withdrawal period. I understand that if I withdraw from the contract within 14 days, I may be charged the reasonable amount permitted by law for the portion of the service supplied before withdrawal.

Development-stage acknowledgement

I understand that Polku Learning is an evolving digital service whose features are continuously being developed and improved. The price of the service has been set taking into account its current stage of development and the current scope of its features.

Marketing consent

I would like to receive tips, news and offers from Polku Learning by email. I can unsubscribe at any time.
